On Monday morning, the Supreme Court of the United States ruled in Kennedy v. Bremerton School District that a public high school football coach in the state of Washington had his First Amendment rights violated after he was placed on administrative leave by the school district and banned from participating in the football program for praying on the field after games in view of students.

“SCOTUS sides with a high school football coach in a First Amendment case about prayer at the 50-yard-line,” SCOTUS Blog tweeted Monday morning. “In a 6-3 ruling, SCOTUS says the public school district violated the coach’s free speech and free exercise rights when it barred him from praying on the field after games.” The case was ruled along ideological lines.

The majority opinion was authored by Justice Neil Gorsuch.

“Here, a government entity sought to punish an individual for engaging in a brief, quiet, personal religious observance doubly protected by the Free Exercise and Free Speech Clauses of the First Amendment. And the only meaningful justification the government offered for its reprisal rested on a mistaken view that it had a duty to ferret out and suppress,” Gorsuch wrote. “Religious observances even as it allows comparable secular speech. The Constitution neither mandates nor tolerates that kind of discrimination.”

Joseph Kennedy, a Marine veteran, was an assistant football coach for the Bremerton High School (BHS) varsity team in 2008 when he started a tradition of kneeling and praying after games. Some students later volunteered to join him. In 2015, a school administrator addressed the issue with the coach after an opposing team complained. After an investigation, Kennedy was later placed on administrative leave and barred from “participating in any capacity in the BHS football program.”

Non-profit conservative legal organization First Liberty Institute took up Kennedy’s case in 2016, and lost in both district court and at the 9th Circuit Court of Appeals. In 2019, the U.S. Supreme Court also denied the request, but four justices – Alito, Thomas, Gorsuch, and Kavanaugh – issued a statement expressing serious concern about how the school district and the lower courts had understood the First Amendment rights of public school teachers.

The Supreme Court sent the case back to U.S. District Judge Ronald Leighton, who again sided with the school district in 2020, as did the 9th Circuit in mid-2021. Attorneys with First Liberty and Kirkland & Ellis refiled the case at the U.S. Supreme Court in September 2021 and the high court agreed in January to hear it.

Thank you for posting this article. Victories such as this are good but tenuous. Until the culture at large changes these wins can easily be swept away with another appointment or vote.

Now is the time to embrace victory with love. Never gloat. Never appear mean spirited. Always show kindness and compassion towards those with whom you disagree. We need to work extra hard to dispel our perception as being judgemental towards others since that is possibly the greatest stumbling block non believers have when the topic of prayer is raised.

It's in the mean-spirited or the sincere where I believe the difference lies.
I am sincerely happy that the Law of the land is finally being upheld.
The lawsuit wasn't brought by those who are for freedom of speech, but rather by those who oppose it.
Whether it's Freedom of Speech or Religious Freedom to Pray, it is still a victory whether religious or secular.
I hear you..
We are not the ones judging them and bringing accusations however,
We stand in defence of our God given rights and Constitution of the Land.

I wasn't accusing you. I meant this in a purely general sense. It's important to remember that perception is oftentimes the driver of reality. For those to whom Christianity equals oppression, rulings such as this will be seen as encroaching tyranny. I know, it's backwards but that's how many do see it. Knowing this we need to be extra sensitive to show love and compassion. It's hard, but we're all God's children and he loves us all equally. You'll recall the parable of the lost sheep, how the shepherd will leave the ninety-nine to find and retrieve the one.

You were married the year i was born . In fact i was about three months old and still in diapers . Yep
fifty years flies by indeed . BUT WHO can measure the SPAN OF ETERNITY . For it has no end .
JESUS IS OUR HOPE , OUR REDEEMER and our salvation . This life is as the dew
on a west texas summer in the morning during a heat wave , it appears but for a second and then vanishes away .
BUT ETERNAL LIFE IS FOREVER and IN JESUS ALONE IS ETERNAL LIFE . Now let all that draws breath both praise and thank the LORD .

I didn't take it as an accusation, I was just weighing the balance of it seen from both sides.
We are living in very high charged emotional turbulent times.
On one side there is a visual depression happening. They hide behind make up, costumes, distortion, hysteria.
I see children that have grown up with no direction, no foundation, no self-control or self respect.
I see adults as if they are children running through the aisles of Toys-R-Us screaming and ranting because they can't have everything they want.
They have no empathy, no remorse, no sense of right or wrong. Chaos. Lawlessness. Anger and hate.
On the other side are those who are striving to stand firm in their principles, their morals. They are pushed back and pushed down for believing in things that are wholesome and good and have been our tradition for centuries.
They are confused, and resolved to hold on to their beliefs in integrity, chivelry, lawfulness, decency.

It is Day and Night. And we have to remember that there is one God who created both in the beginning.
The only difference between the two is the Light. And it's our duty to bring that light to the world.
But I believe the darkness scares us. We don't understand it. It's alien to our very marrow in our bones.
It's not a fear of srength or weekness, it's more a fear of amazement and helplessness.

But we can't stop being joyful and happy, celebrating goodness and kindness and love, because we are afraid we will be ridiculed or we may offend someone.
This joy, this happiness is exactly what they are lacking. These emotions are gifts that we share with each other.
It lifts us up, it makes us strong, it gives us hope.
But they don't have these gifts. They have torments and punishments, victimism (is that a word) , they feel victimized, oppressed, depressed,
injustice, no peace.

I don't believe this is their choice. Somehow it was placed on them by a system that feeds off of innocence and fear and darkness.
Are we as christians willing to bring the light to a world that's gone cold and dark?
And I believe the only way we can do that is to set ourselves as examples.
Patience, endurance, long suffering, kindness.. these have to be more visual and observable than the darkness that is looming over the world.
They have to see something that they want, that they need, that they are lacking, in us.
And the one thing I believe is most important and a good foundation is Hope.

I try to put myself in other people's shoes and walk the walk they are taking.
It goes against my very core beliefs, my understanding, overcoming the fear of looking evil in the face and knowing the true enemy.
It's easier to point a finger and accuse the other, than to stand in the shoes of the accused and recognize the changes needed in oneself.
It's the man in the mirror, syndrome.
But on the other hand, we shouldn't hide behind a bushel, or under a table as not to offend others.
We need to show them what Love looks like.
But you can't show anyone anything if you don't first possess what it is you want to show.

It's a difficult time for both sides. And I believe right now we're in the center of the storm.
Somehow the world and it's reality took a bad turn off the path.
It's up to us to get it back in line.

For we do not wrestle against flesh and blood, but against the rulers, against the authorities, against the cosmic powers over this present darkness, against the spiritual forces of evil in the heavenly places.

It is certainly a problem for the church that wants to enforce it's religion on those who would choose another.

True religious liberty is not only freedom from the state to rule the affairs of the church, but also freedom from the church to rule the affairs of the state.
During Jesus' time on earth, Israel was under the terrible yoke of an oppressive occupying power. They had no religious freedom... Rome even decided who would be the high priest. Bribery often decided who Rome chose. Jews who acted as tax collectors for Rome were reviled as collaborators. Yet despite having Simon the zealot amongst his disciples, and likely the rest being very sympathetic with Simon's political and religious desires for freedom, Jesus invited himself to dinner at Matthew's house, sharing that dinner with a number of Matthew's fellow collaborators.
I believe the church needs to seriously rethink it's attitude to what it views as political oppression, and it's response to it, taking Jesus as us example. We are the salt of the earth. We don't add flavor to the world by being separate from it, but by being mingled with it without losing the flavor. And we don't seek to take over government: religious liberty works both ways, not just freedom from state interference in church affairs, but freedom from church in state affairs. History has witnessed both the above, and neither ended well for God's people

Sounds like SCOTUS has been making some very good decisions lately.

Do we in the western socities have worse persecutions than the apostels did .
NOPE .
YET I read all their letters . Not a one put their hope in govts or kings of this world .
Nor should we .
Now as the religoins merge only more and more under the mindset that a true christain
just hugs and embraces but dont DARE CORRECT
the true lambs who do so will be persecuted more and more .
I am so sorry so many bought into the line to just find common ground with mormons , catholics and who knows what else
amongst the faiths . And it dont stop there either nor WILL IT . ITs fast moving into find common ground

That doesn't mean we are to trust the wolves. It doesn't mean e become a part of their agendas for globalism and ecumenism. It does mean though that those people we are mingling with, (salt is of no use if isolated and left to minister to one another like the Amish) are all loved by Jesus, Who died and redeemed every one of them. It means we are to explain who we are, why we are different, why we believe what we believe, and why we cannot partake of their errors. We cannot do this if they see us as their enemy. They will not understand or even believe we are Christians if we do not act as Christians and walk in the footsteps of Jesus, doing good, being good, and being salt, seasoning their communities. Planting ourselves amongst them means that they will benefit by our presence. They will not benefit by our presence if we stay aloof and distant, preaching at them in a superior self righteous manner from a distance that is bereft of love. Yes, there is a real love, a love that doesn't neglect our neighbours, our workmates, our families. A love that cares deeply for their welfare in this life, and concern for the eternal security and the truth as it is found in Jesus. We can do this without joining their institutions and becoming one in their clubs and organisations.

8 Then shall thy light break forth as the morning, and thine health shall spring forth speedily: and thy righteousness shall go before thee; the glory of the LORD shall be thy rereward.

Amigo, throughout the OT Israel was called upon to be a light to the gentiles, to be witnesses to God's grace and power. But they didn't do that, but became isolationist in their dealings with the nations around about, and in the end succumbed to the idolatry and evil practises of their neighbours, and did even worse themselves to such an extent they became a horror and a byword to even the heathen. By all means speak the truth, but do it in love, demonstrating that you actually care for not only their eternal well-being, but also their present health and happiness. That was the ministry of Jesus. We ought to do no less. And God will give us the power to remain faithful to His trust.
