I think he handled the situation as best as he could with his consistent rulings as he has always performed on the court.
Basically he is an originalist....which is "what did the Founding Father's intend with the Constitution when it was written?" Is the overriding principle he uses to make rulings concerning legal matters.
The "Populist viewpoint" refers to what we think the language of the constitution mean today as evidenced by the plethora of other people's(lower court judges) majority decisions.
People try to do the same thing with scripture....which is why there are so many apostate churches today. And it's caused any number of rifts in our political arena.
For example in Ephesians 4 Paul admonishes the people at Ephesus to not get drunk on wine. So does that mean it's acceptable to get drunk on beer? (Which they had available as well) How about drunk on Fireball (a type of liquor popular today) or how about intravenous narcotics? (Which they did not have in any fashion)
We today can extrapolate with an originalist viewpoint that these sorts of behaviors are also unacceptable....just as a populist viewpoint might as well; however, they might allow Marijuana or some other intoxicant they believe to be harmless. Which an originalist refuses to allow.
Once upon a time it was considered extremely wicked to visit a theater....today we watch videos with abandon. Is it a moral sin to watch a video? Entertainment activities are not mentioned or even hinted at in scripture...only pagan worship of idols. Games, puzzles or music are completely ignored as for entertainment so it must be permissible up to a point (as is everything)
The USA constitution is unique in world history. It has created the longest lasting nation in human history. Nobody has outlasted the USA. The Roman Empire only kept the name....but each Caesar/Emperor was unique in what they did or didnt do during their rule. Many laws and policies were changed with each new Ruler.
My thought is let's not fix what is not broken.
