Girl, 16, threatened with arrest as police said

her Covid Instagram posts were causing ‘panic’

A teen who was threatened with jail time after posting about Covid on social media has won a lawsuit over her right to free speech.

Amyiah Cohoon returned home from hospital in March 2020, after being taken in for a fever and difficulty breathing, and posted on Instagram that she had Covid.

“Hey guys … sorry I’ve been on a long break. I wont be back for a while longer due to me [now] having the Covid-19 virus,” she wrote.

No cases had been recorded in her county of Wisconsin at the time, reports the Washington Post, and “concerned citizens” started calling local officials.

A sheriff’s sergeant came to her family’s house and told Ms Cohoon’s father “If [the post] doesn’t come down, the sheriff has directed me to issue disorderly conduct citations, if not start taking people to jail,” showed dash-cam video. “Because it is causing a disturbance to the public.”

Although the post was removed, MsCohoon’s family filed a federal lawsuit over the threat the following month, against the sheriff’s office.

On Friday, a federal judge ruled that the sheriff’s office had violated Ms Cohoon’s right to free speech, regardless of whether or not she had actually contracted Covid.

Ms Cohoon had come down with a fever and cough and began having difficulty breathing, according to court records. She was diagnosed with an “acute upper respiratory infection”, and while doctors said that her symptoms matched those of Covid she was ineligible to be tested for the virus.

US District Judge Brett Ludwig said in his ruling that accepting the sheriff’s argument for arresting the then-16-year-old – who police accused of sowing anxiety and “panic” via her posts – would “gut” the protections of the First Amendment. Mr Ludwig added that those protections apply “in times of tranquility and times of strife”.

Lawyer Luke Berg, who represented Ms Cohoon, told the Washington Post:“It’s a very strong statement … that cops can’t police social media.”

Our freedoms (in the USA) are supposed to include the right of privately owned businesses to refuse services for most reasons other than discriminatory practices aimed at "protected" groups. These rights clearly have been eroded, in part by laws intended to protect civil liberties.
It would seem like anti discrimination laws are being applied preferentially, but political affiliations and shared political philosophies don't constitute a protected group.
Social media companies are careful to identify the sources of posts that they find as objectionable by political associations. Religious objections to issues are labeled political "far right" or conservative, and lumped together with those of white supremacists, Nazis, and clansmen.
Censorship is justified on the basis of limiting "hate speech" and more recently "misinformation" as determined by "fact checkers."
The only lawful recourse to unfair censorship by privately owned businesses, other than by boycott, is civil legal action based upon discrimination by race, religion, age, and sexual orientation.
Since the large social media companies generate a lot of wealth for the owners, they can generally afford a large legal staff and present long and costly legal disputes that the average end user isn't financially equipped to fight.
It isn't "fair" to have the indiscriminate power to silence people, but it is entirely legal under a vaguely defined set of criteria which gives private ownership the benefit of the doubt.
If the government provided a public social media platform, different laws would apply regarding equal access, but then the government would have full censorship power over the public "narrative " and we would only see what government allowed us to see.
All things considered and in a fallen world, I think that the system in place is the best guarantee of free speech, but with the protections guaranteed to property owners.
If someone came into your house to harass your family and friends, attempting to change their beliefs and practices, would you just tolerate them, or would you remove them from your property?
I praise the Lord that I have the freedom to disallow tresspass, and access to law enforcement to forcibly remove anyone without legitimate and lawful reason to be on or in my property.

Incoherent rants mingling fictions with advertisements for satanism probably doesn't do a whole lot to advance the gospel, but if unloading your fears here makes you feel better, why not? I just wouldn't expect a lot of favorable interaction with mature believers.

I remember a world before cell phones, before computers, before social media.
Our socialising was having block parties in the summer, when everyone brought something and one of the kids had his 45 records and would play the DJ for the day. Sitting on the stairs at 1am because it was so hot in the 3rd floor apartments, and A/C's weren't around yet.
And all the neighbors just complaining about how hot it was.
Everyone with their brooms sweeping off the sidewalks talking about how some group of kids got rowdy the night before, or some new recipe Charlotte made for the bake sale.
Everyone with their shovels, removing the snow from the stairs and sidewalks. Helping out the seniors who had trouble walking through the snow with their groceries.

I grew up in the city of Boston. Lived in a 3rd floor cockroach and mouse infested apartment building.
Drank powdered milk and Zarex. I liked the grape, my brothers liked the orange flavored.
I had a small harmonica and on sunday early in the morning I would walk down the street humming and playing my songs.
Nobody cared, nobody complained.

Gossip hour was after dinner on nice evenings when everyone brought out their folding chairs and sat in random groups on the sidewalks.
Everybody knew everybodies names. And if you were new to the neighborhood, that newness didn't last long.
We either liked you or we didn't. At least you knew where you stood. But time always melted the newness off and eventually we all fit in somewhere.

I remember playing hide-n-seek, red rover, kick the can. Growing up as a kid in the city wasn't hard, you just had to keep your nose clean.
Because you knew everyone knew your parents.

The world has changed.

I once wrote a paper for presentation in my Intro to Computers class. It had to be about this new thing called the internet and what kind of future it would have. Some people wrote about Bill Gates, I don't remember what they all said because I was kind of worried about how my presentation was going to go over.
I wrote about how I saw the future becoming cold and distant. No more need for physical interactions and how people would grow farther and farther apart emotionally. This was back in the early 90's. I didn't even have a computer yet. I had to use the one at the library.
Needless to say the teacher wasn't impressed with my premonitions and gave me a C+ . I think I got that because he didn't want me back in his class next semester.

The world isn't much different from how I saw the future back then. Parhaps more violent and aggressive.
I still don't have a cell phone. I have a PC, no laptops or Ipads.
My life is pretty solitary now. I live in the country, those city days are over.
I wish the kids today could live the life I lived when I was a kid.

When the world gets crazy, just turn off your cellphone.
