The point in law is you need a hurt party and a party at fault, and the law that shows the parties fairly.
The real issue here is a lack of audit, and lack of rules about failure to record the vote and audit the vote.
You then create laws and penalties around failure to comply with the audit, and security around the machines.
There is technology are ways of making this bullet proof, so there is no debate. But it costs money and each society has to choose to implement or make do. The introduction of mass mail in voting needs better controls and methods, that is the lesson of this election, except probably nothing more will be done, until the next election with lots of complaints.
Chain of custody. A vote is taken. A number issued. This number is put against a voter, and tracked through the system to the count.
Each voter in the chain can be checked and verified, so all the totals always add up. Each voter is verified as to identity through identity recognition software as already exists. You cannot fake such a chain of custody or invent new voters, dead voters, double votes. You can stop tracing of who voted how through encryption and banning of tracing, just verification of the validity of the chain. This is not massively sophisticated or difficult to implement. But how willing are people to actually do something about it. Is it really a challenge to democracy or just another ball to kick the opposition with? Some countries have actually forced voter ID's and each citizen is forced to participate, ie express an opinion, and it is all open, and anyone can challenge any part at any time. You can then have referendums, and open voting, and closed voting, so people declare their positions or in controversial issues it is hidden. It is much harder to take over such societies, because positions and opinions are open and visible, and need to be addressed. Politicians dislike this kind of democracy, because it is harder to fake real movements and create extreme positions when clearly there is not support for it. In a more technological world, I can see how this is our future, whether we like it or not, because we need to avoid fake news, conspiracy theories and grow up and face the real issues that as societies we need to own and work with.
One serious issue many here including myself will face, is how do we want to die, or survive? A slow lingering death in great pain, or a good end with finality? No joke, this is something I have faced with some uncles and aunts, and one my mother is living with.
