I think you heard him wrong. This is what I heard and what the transcript says:
"If Americans send me a Congress that supports the right to choose, I promise you, I will restore Roe v. Wade as the law of the land again!"

And we all know that Roe v Wade, which was a Constitutional decision declaring a Constitutional right to abortion, cannot be restored by any legislation. That would take a Constitutional amendment, not a bill from Congress. What Biden meant -- and how he was understood by most, I suspect -- is that he would sign legislation declaring a federal (nationwide) right to abortion up to X weeks of pregnancy.

It's up to congress to decide when a person is. (We The People)

The Judiciary is not the legislative branch, they can not make laws.
They interpret the laws congress makes and determines if they are constitutional.
The Executive Branch upholds the laws or reinforces the laws which congress legislates.
The country is divided on when a person is.
So the Judiciary can not force an opinion one way or the other.
That's why Roe v. Wade went back to the states.
No legislative power from the bench.
It's up to the people to decide and elect officials who will legislate.

Except to the extent that "person" appears in the Constitution. The courts have the job of telling us what "person" means in that context. No Congressional statute can impinge on that exclusively judicial power.

I can't answer that question.
Under the constitution is the right to life.
So then comes the question, when does life begin?
Is the egg of a woman a living thing? Is the sperm of a man a living thing?
Do these two things create a new living thing?
A sperm is nothing more than a cell which very predefined function. It's not able to live a life of it's own. Sperm are unquestionably alive, according to all or most sensible definitions of life (They move around, they have goals, they eat things, they die) . They are not, however, a human or animal life.
Women are born with all the eggs they will ever have; their number begins to decline at birth. A typical fetus has about 20 million eggs, says Dr. Seifer. A newborn has about 2 million, and 11,000 die every month prior to puberty.
So if the sperm and the egg can die, that must mean they had life in them.
And when the two become one, then there is a newly created being.
That's how I see it, but the world has many of it's own interpretations.
Under the Constitution is the right to Life, not the right to kill.
