You don't think about the MILLIONS of babies murdered by the Dems?
I never been to law school.
But these Supreme Court nomonation hearings have been an awesome learning experience for me.
I learned a lot about when the SCOTUS can and can't put it's foot on other States necks.
I'm sure if I ever run for Supreme Court this summary I'm about to write, can and will be used against me.
I don't have much worries about that though.
Your accusation puts the full weight on Democrats.
States Rights vs. the Supreme Court.. aka Roe vs Wade.
Decision:
Roe v. Wade, legal case in which the
U.S. Supreme Court on January 22, 1973, ruled (7–2) that unduly restrictive state regulation of
abortion is unconstitutional.
How did they come to this conclusion?
In a majority opinion written by
Justice Harry A. Blackmun, the Court held that a set of Texas statutes criminalizing abortion in most instances violated a woman’s
constitutional right of privacy, which it found to be
implicit in the liberty guarantee of the
due process clause of the
Fourteenth Amendment (“…nor shall any state deprive any person of life, liberty, or property, without due process of law”).
So in my own words. The Supreme Court decided that Texas was stepping over the line by denying not only a woman's right to privacy, but also life, liberty and property.
And of course where one State falls they all fall.
Now the vote was 7-2. Who's on the seats?
The decision was 7-2, with Chief
Justice Warren E. Burger and six other
Justices voting for "Jane
Roe", and
Justices William Rehnquist and Byron White voting against it. The decision divided the nation and is still controversial today.
The others are: Blackmun, joined by
Burger, Douglas, Brennan, Stewart, Marshall, Powell.
You know how this all started?
McCorvey revealed herself to the press as being "
Jane Roe" soon after the decision was reached, stating that she had sought an
abortion because she was unemployable and greatly depressed.
SMH
The decision involved the case of a woman named
Norma McCorvey—known in her lawsuit under the pseudonym "Jane Roe"—who in 1969 became pregnant with her third child. McCorvey wanted an abortion, but she lived in Texas, where abortion was illegal except when necessary to save the mother's life. She was referred to lawyers
Sarah Weddington and
Linda Coffee, who filed a lawsuit on her behalf in U.S. federal court against her local
district attorney,
Henry Wade, alleging that Texas's abortion laws were unconstitutional. A three-judge panel of the
U.S. District Court for the Northern District of Texas heard the case and ruled in her favor. Texas then appealed this ruling directly to the U.S. Supreme Court, which agreed to hear the case.
well, there's a lot of history in wiki about the case.
The original reason for seeking an abortion was based on a lie though. She told the court she had been raped thinking that was a legal reason for an abortion. At the time it wasn't. Only in cases of the Mother's health was it even up for consideration.
So she changed her story, found some lawyers to take the case, they won in the lower courts and was challenged by the State of Texas to take it to the Supreme Court.
Now in my own opinion...
I believe the only way to fix this is to put the decisions back in States hands and let them decide what is acceptably constitutional or not.
The very foundation of the decision was based on a lie.
I think that should be considered.
Morally, ethically, judiciously, and any other-ly there is.
But then I'm bias because my own foundational belief says No way.
That's why I'm not worried about being on a court bench.
I tell you a little secret though I never talked about, as far as thinking about it.
I had a dream one night. I was kind of inbetween sleep and awake, that dozing area.
I saw in my mind what looked like every abortion that ever was or will be.
I barely made it to the bathroom to vomit.
I was so distraught I called into work for 3 days saying I was sick and couldn't come in.
By the 4th day I quit my job.
I can't think about a lot of atrocities like where rib eye and pork chops come from.
I won't discuss hunting.
I know these things are out there and there isn't much I can do about it.
The only thing I can do is not eat rib eye and pork chops..
or go hunting.
MUCH LOVE
HUGS
