Same-sex couples have a constitutional right to marry, the California Supreme Court ruled Thursday.The court’s 4-to-3 decision striking down state laws that had limited marriages to unions between a man and a woman makes California only the second state, after Massachusetts, to allow same-sex marriages. The decision, which becomes effective in 30 days, is certain to be an issue in the presidential campaign.“In view of the substance and significance of the fundamental constitutional right to form a family relationship,” Chief Justice Ronald M. George wrote of marriage for the majority, “the California Constitution properly must be interpreted to guarantee this basic civil right to all Californians, whether gay or heterosexual, and to same-sex couples as well as to opposite-sex couples.”California already has a strong domestic partnership law that gives gay and lesbian couples nearly all of the benefits and burdens of heterosexual marriage. The majority said that is not enough. Given the historic, cultural, symbolic and constitutional significance of the concept of marriage, Chief Justice George wrote, the state cannot limit marriage to opposite-sex couples. The court left open the possibility that another terms could denote state-sanctioned unions so long as that term was used across the board.The state’s ban on same-sex marriage was based on a law enacted by the Legislature in 1977 and a statewide initiative approved by the voters in 2000, both defining marriage as limited to unions between a man and a woman. The question before the court was whether those laws violate provisions of the state Constitution protecting equality and fundamental rights. Conservative groups have proposed a new initiative, this one to amend the state constitution to ban same-sex marriage. If it is allowed onto the ballot in November and approved by the voters, Thursday’s decision would be overridden. The groups have gathered more than a million signatures on initiative petitions and submitted them to the state.Justice Marvin R. Baxter, dissenting, said the majority had should have deferred to the state Legislature, which has in recent years increased legal protections for same-sex couples.“But a bare majority of this court,” Justice Baxter wrote, “not satisfied with the pace of democratic change, now abruptly forestalls that process and substitutes, by judicial fiat, its own social policy views for those expressed by the people themselves.” The California Legislature has twice passed bills allowing same-sex marriages, but they were vetoed by Gov. Arnold Schwarzenegger, who said they would overturn the 2000 referendum.Mr. Schwarzenegger opposes the current ballot initiative seeking a constitutional ban on same-sex marriage. He said Thursday that he respected the court’s decision and would not support overturning it.In 2004, Mayor Gavin Newsom of San Francisco directed the county clerk to issue marriage licenses to gay and lesbian couples. Before the California Supreme Court halted the practice, more than 4,000 same-sex couples received marriage licenses in San Francisco.

Ugh... Makes me feel like I want to return to my vomit...being flesh, it feels good. But being a soul as well, my soul hates it. For I can never love both natures. Either I hate the one and love the either or do the opposite...I rather stay out of my comfort zone and live with Him anyday.

Eh, well.... little do they know that it is God who institutes marriage, not men and women. I do not believe any homosexual couple has ever been married, or ever will be married, no matter how meticulate the ceremony has been. All they have done is put on a play for thier abomination.

Well, despite the fact that the majority have continually spoken - even in Oregon which is traditionally liberal in this respect, our voices are being ignored and the majority is being overtaken by the minority. Welcome to the continued wrecking of the American government.

Oregon is pretty republican. It's just the cities that are liberal. We've got our own share of farmers and cowboys. Thank God for them.

But then.......you are not a Christian nation anyways right? You are a secular nation?I don't understand why the gays want to have equal access to marriage? It doesn't make much sense to me. But then again I have never understood gays and found them openly hostile towards me all the time.

Well, unfortunately the powers at be have found the flaw in the Constitution. It's how the Judicial system works in that once Judge is appointed, he or she is appointed for life. They have overstepped their originally designed bounds by legislating through their rulings which was never, ever the intention of the Judicial branch of government.It's become the American version of a dictator. They commonly rule contrary to the will of the people.Article IIII, Section 1 of the US Constitution:
The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office.
Section 2:
The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.
The clear point there is that they are supposed to rule on the laws, not rule the laws. Judicial Review set the standard, but unfortunately that standard is now abused.And, for those that say the Constitution was not biblically-based:Section 3
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.
Deuteronomy 17:6
At the mouth of two witnesses, or three witnesses, shall he that is worthy of death be put to death; but at the mouth of one witness he shall not be put to death.

I have been reading the Old Testament for about a year and a half now. I am convinced that God didn't want men to form governments. I think He wanted to be our King. The point I am getting to is that things that are against the bible would never be made lawful in that kind of society.I am very sad at hearing this news. Everything has been pointing to the destruction of the US for awhile now, this is just the straw that broke the camels back. I know we are in for hard times and I know we will be judged. I hope it will be swift and painful and that we will not forget or let our childrens, children forget.

I just don't get this at all. Are there no absolutes any more? Does this mean that I can now affix something together with two bolts or two nuts as securely as a nut and a bolt?And does this now mean men can have babies?
